Your privacy is important to NorthMarq, and we go to great lengths to protect it. This Privacy Notice applies to the collection of information about you or your company via this NorthMarq website (the “Site”), our loan servicing Portal, via email, over the phone, or from third parties. To provide our commercial real estate services we may collect information from and about you. Most of this is information related to business entities, but we also collect some personally identifiable information. We will not disclose your information to any person or organization outside NorthMarq, except as described in this Privacy Notice.

Here, you will learn what information is collected, how and when we might use that information, how we protect information, who has access to information, and how to correct any inaccuracies in your information.

Types of Information That We May Collect

To create an account, you will need to provide us with certain personally identifiable information, including your loan number, social security number of taxpayer ID number, and contact information.  You will need to give us accurate contact information, keep that contact information accurate, and set a unique password that you keep confidential. When you access that account, we may collect information about your use of those services.

If we provide commercial real estate services to you, we will collect information regarding the property, the loan or loan portfolio, and any other information (including financial information) that may be required to provide those services.

If you provide information to us through our “Careers” tab, will we collect the information requested in the online form, and any other you provide that will allow us evaluate and process your application.

When you interact with our employees, communicate with us via email, or use our Portal we may collect the information that you provide to us.

Web server logs: When you visit the Site, we may track information to administer the site and analyze its usage, and we may use third party online analytics services. Examples of information we may track include:

  • your internet protocol address
  • browser used (user-agent)
  • links clicked
  • the state or country from which site was accessed the date and time of your visit
  • the website you visited before you entered our Site
  • the pages viewed within our Site

Cookies: Our websites use cookies (i.e., small bits of text that our servers place into a file on your computer’s hard drive). This is used to provide personalized functionality. You can reject cookies by changing your browser settings, but be aware that this will disable some of the functionality on our websites.

How we Use the Information That We Collect

We will use the information we collect to provide commercial real estate services, including loan servicing on behalf of lenders, and to respond to your requests for information.

We may use the information we collect to provide you with promotional information we think you may be interested in. If you don’t want to receive promotional materials from NorthMarq, you can contact us to opt out at any time. If you apply for a position, we will use your information to evaluate and process your application.

We do not sell, rent or lease mailing lists or other information to others, and we will not make your personal information available to any unaffiliated parties, except as follows. 

  • When we service commercial loans, information about we have about a particular loan may be shared with both the borrower and the lender and with others as necessary to provide those services.
  • To agents and/or contractors who may use it on our behalf or in connection with their relationship with us. These agents or contractors may have access to your information if needed to perform their functions, but may not use such information for their own purposes.
  • In connection with our Site, we use third-party online analytics services such as those of Google Analytics. These analytics services use automated technologies to collect information (such as email address, IP address, and device identifiers) to evaluate use of our services and to diagnose technical issues.   • To respond to your requests, or otherwise with your consent.

  • We may share information that does not identify you personally for any reason at our sole discretion.

How We Protect Your Information

NorthMarq uses reasonable physical, technical, and administrative measures to prevent the loss, misuse and alteration of information under our control.  Because no method of data transmission or storage is 100% secure, we cannot guarantee the absolute security of your information. We allow our employees and service providers to access your information only when the information is necessary for them to do their jobs. Our employees and service providers who have access to your information are required to protect it and keep it confidential.

You are responsible for keeping your password confidential and managing your credentials. If you suspect that your credentials have been compromised, change your password.

We will keep your information for as long as needed to provide you with our services and otherwise at our discretion or in accordance with applicable law.

Process to Correct Information

If you wish to request changes to your personal information, you may do so within your account, or by sending an email message to ClientPortal@NorthMarq.com

Links to Other Sites

The Site may contain links to other websites. NorthMarq is not responsible for the privacy practices or the content of those sites. When you leave our site, review the privacy statements of the other sites you visit.

Children’s Information

We will not knowingly collect personally identifiable information from children. If we become aware that we have collected information personally identifiable information about a person who is under the age of 13, we will remove that information from our files.

Our services are directed towards users who live in the United States. By establishing an account, making a purchase, or using the Site, you consent to the collection, storage, processing, and transfer of your information in pursuant to US law. We do not intentionally collect information from residents of the European Union.

CALIFORNIA PRIVACY NOTICE

California Civil Code Section 1798.83 permits California residents to request certain information regarding our disclosures of your personal information to third parties for their direct marketing purposes. Definitions Specific to this Notice

Your Rights

Right to Know About Personal Information Collected, Disclosed, or Sold

You have the right to request that NorthMarq disclose to you what Personal Information we collect, use, disclose, and sell. You may exercise this right by following the methods described under the subsection titled “Exercising Your Rights” below.

Right to Delete Personal Information

You have the right to request that NorthMarq delete Personal Information we may have collected about you. You may exercise this right by following the methods described under the subsection titled “Exercising Your Rights” below.

Please be aware that we may not always be able to delete your Personal Information. For example, there may be business or operational reasons why we need to retain your Personal Information. If we deny your request to delete your Personal Information, we will inform you of the basis for our denial in our response to you.

Right to Opt-Out of Sale of Personal Information

We do not sell Personal Information. You may exercise your right to opt-out of any future sale of your Personal Information by following the methods described under the subsection titled “Exercising Your Rights” below.

Right to Non-Discrimination

You have the right not to receive discriminatory treatment from NorthMarq for exercising any of your rights described under this “Your Rights” section. This means we will not treat you differently for exercising any of the rights described above. Please note that a legitimate denial of a request for information, deletion, or to opt-out is not discriminatory, nor is charging a fee for excessive or repetitive consumer requests as permitted by the CCPA.

Exercising Your Rights

To exercise your rights, you must submit a verifiable request to us. To submit a verifiable request, please follow one of the methods described below.

To verify your request, we will compare the pieces of information that you submit with your request to the Personal Information we have on file to confirm that the data we have identified corresponds to you, and that the person submitting the request is authorized to do so.

You may designate an authorized agent to submit a request on your behalf. Pursuant to the CCPA:

  • Only a business entity or natural person registered with the California Secretary of State may act as an authorized agent.
  • You must provide the authorized agent written permission to exercise your rights under the CCPA on your behalf.
  • We may deny a request from an authorized agent on your behalf if the authorized agent does not submit proof that he, she, or it has been authorized by you to act on your behalf if we request such proof, as permitted by the CCPA.
  • Even if you use an authorized agent to exercise your rights under the CCPA on your behalf, pursuant to the CCPA we may still require that you verify your own identity directly to us.  This provision does not apply if you have provided with a power of attorney under California Probate Code sections 4000 to 4465.

We will confirm receipt of your request within 10 business days and respond to your rights request within forty-five (45) days from the date we receive it.  In some cases, we may require additional time to complete your request and will inform you if additional time is needed.  Where additional time is needed, we may take up to a maximum of ninety (90) additional days to complete your request.
